La reforma constitucional del maíz transgénico de 2024 desde la perspectiva del derecho internacional económico

El artículo aborda un conflicto fundamental entre la reciente reforma constitucional en México, relacionada con el maíz transgénico, y las “disciplinas de libre comercio” que el derecho internacional económico impone al sistema agroalimentario nacional. El objetivo principal del estudio es demostrar la incompatibilidad de dicha reforma con los principios de liberalización comercial que rigen en el derecho internacional económico. La investigación se desarrolla mediante un enfoque metodológico que integra tanto fuentes normativas como doctrinales. Este enfoque permite un análisis minucioso y crítico de los antecedentes legislativos de la reforma y de su contenido jurídico específico, estableciendo comparaciones con el marco normativo internacional vigente. El estudio revela de manera concluyente que las disposiciones introducidas por la reforma constitucional del maíz transgénico efectivamente vulneran las normativas internacionales que promueven la liberalización del comercio de productos agrícolas, en particular del maíz. El artículo concluye que, para lograr un equilibrio entre los objetivos de la reforma y la promoción de un comercio internacional libre y justo, es indispensable un cambio de paradigma en el derecho internacional económico. Solo mediante una reconfiguración de sus estructuras y principios será posible alinear las metas internas de México con las expectativas globales en materia de comercio y sostenibilidad.
